Aadya Acres Pvt. Ltd. ("Aadya Acres", "we", "our", or "us") is a real estate technology company registered in India, operating the Aadya Acres mobile application and website (collectively, the "Platform"). We act as the data controller for personal data you provide through our Platform.

2. Information We Collect

We collect information in three ways: information you give us, information we collect automatically, and information from third parties.

Information you provide:

• Account Information: Full name, email address, mobile number, profile photo, and date of birth when you register an account.
• Property Listings: Property details, photos, videos, documents, and pricing information you submit when listing a property.
• Communications: Messages sent through our in-app chat, enquiry forms, emails, and support tickets.
• KYC / Verification: If you choose to get verified, we may collect government-issued ID documents.
• Payment Details: Transaction information when you purchase premium services. We do not store card numbers — payments are processed by certified PCI-DSS payment gateways.

Information we collect automatically:

• Usage Data: Pages and listings viewed, search queries, filters applied, time spent, and features used.
• Device Data: Device type, operating system, browser, app version, IP address, and device identifiers.
• Location Data: With your explicit permission, we collect precise GPS location to show nearby properties and improve recommendations.
• Cookies & Tracking: We use cookies and similar technologies to maintain sessions, remember preferences, and analyse usage. See our Cookie Policy section below.

3. How We Use Your Information

We use your data only for legitimate purposes related to providing our service:

• To create, maintain, and secure your account
• To show you relevant property recommendations personalised to your preferences and location
• To enable communication between buyers, sellers, and agents
• To verify listings and user identities for platform integrity
• To process transactions and send payment confirmations
• To send service notifications, alerts, and updates you've opted into
• To improve app performance, fix bugs, and develop new features
• To detect and prevent fraud, spam, and policy violations
• To comply with applicable Indian laws and regulatory requirements

4. Sharing of Your Information

We do not sell your personal data to any third party. We share your information only in these limited circumstances:

• With Property Owners/Agents: When you submit an enquiry, your name, phone number, and email are shared with the relevant listing owner or agent to facilitate contact.
• Service Providers: We share data with trusted vendors who help operate our platform — cloud hosting (AWS), push notifications (Firebase), analytics (Mixpanel), and payment processing. These vendors are contractually bound to protect your data.
• Legal Compliance: We may disclose your data when required by law, court order, or a government authority in India or applicable jurisdiction.
• Business Transfers: In the event of a merger, acquisition, or sale of our business, user data may be transferred as part of that transaction. You will be notified in advance.
• With Your Consent: For any other purpose, only with your explicit consent.

5. Location Permissions

The Aadya Acres app requests your device's location (precise or approximate) to show properties near you, improve search results, and provide neighbourhood insights. This permission is optional — you can deny it and still use the app with manual city/locality input. You can revoke location access at any time in your device Settings → App Permissions.

6. Camera, Microphone & Storage Access

If you list a property or upload a profile photo, the app requests access to your camera and device storage solely to enable photo/video uploads. The app requests microphone access only for video recording in Property Shorts. These permissions are only active when you explicitly trigger the relevant feature.

7. Cookies & Tracking Technologies

We use cookies and similar technologies on our website for session management, preference storage, and analytics. You can control cookie settings in your browser. Rejecting non-essential cookies will not affect core functionality.

8. Data Security

We implement industry-standard security measures including 256-bit SSL/TLS encryption for all data in transit, encrypted storage for sensitive data at rest, regular security audits and penetration testing, access controls and role-based permissions for our team, and automated anomaly detection. No internet transmission method is 100% secure. We will notify you promptly in the event of any data breach that affects your personal information.

9. Data Retention

We retain your personal data for as long as your account is active or as needed to provide you with our services. If you delete your account, your personal data will be permanently deleted within 30 days, except where longer retention is required by applicable Indian law (e.g., financial records for 7 years under the Companies Act).

10. Your Rights

Under applicable Indian data protection laws and our own commitment to user rights, you have the right to:

• Access: Request a copy of the personal data we hold about you
• Correction: Request correction of inaccurate or incomplete data
• Deletion: Request deletion of your personal data ("right to be forgotten")
• Portability: Request your data in a machine-readable format
• Withdraw Consent: Withdraw consent for any data processing based on consent
• Opt-out: Unsubscribe from marketing communications at any time

11. Children's Privacy

Aadya Acres is not intended for persons under 18 years of age. We do not knowingly collect personal data from minors. If you are a parent or guardian and believe your child has provided us with personal data, please contact us immediately at privacy@aadyaacres.com and we will delete that information promptly.

12. Third-Party Links

Our Platform may contain links to third-party websites or services. We are not responsible for the privacy practices of those external sites. We encourage you to review the privacy policies of any third-party service you visit.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time as our services evolve or laws change. We will notify you of significant changes by posting a notice in the app and/or sending you an email at least 14 days before the changes take effect. Your continued use of the Platform after changes are effective constitutes acceptance of the revised policy.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Aadya Acres Pvt. Ltd. ("Company", "we", "us"). By accessing or using the Aadya Acres Platform in any way, you confirm that: (a) you are at least 18 years of age; (b) you have read and understood these Terms; and (c) you agree to be bound by them.

2. Nature of the Platform

Aadya Acres is a technology platform that facilitates the listing, discovery, and connection of real estate properties between independent buyers, sellers, tenants, and agents. Aadya Acres Pvt. Ltd. is not a real estate broker, agent, developer, or financial institution. We do not own any listed properties and are not party to any transaction conducted between users on the Platform.

3. User Accounts

To access most features, you must create an account with accurate and complete information. You are responsible for: maintaining the confidentiality of your login credentials, all activity that occurs under your account, notifying us immediately at support@aadyaacres.com if you suspect unauthorised access to your account. We reserve the right to terminate accounts that provide false information or violate these Terms.

4. Permitted Use

You may use the Platform solely for lawful personal or commercial real estate purposes. You agree not to:

• Post false, misleading, fraudulent, or illegal property listings
• Impersonate any person, entity, or Aadya Acres staff member
• Use automated bots, scrapers, or tools to extract Platform data without written permission
• Attempt to gain unauthorised access to any system, server, or database
• Spam, harass, threaten, or abuse other users in any manner
• Upload viruses, malware, or malicious code of any kind
• Use the Platform for any unlawful purpose under Indian law
• Circumvent or manipulate our verification or review systems

5. Listings & Content

By posting a property listing, you confirm that: (a) you have the legal authority to sell, rent, or list the property; (b) all information provided is accurate, current, and complete; (c) you grant Aadya Acres a non-exclusive, royalty-free, worldwide licence to display, distribute, and promote the listing on the Platform. Aadya Acres reserves the right to remove any listing or content that violates these Terms, our community guidelines, or applicable law, at any time and without notice.

6. No Warranty on Listings

While we make reasonable efforts to verify listings, Aadya Acres makes no warranty — express or implied — regarding the accuracy, completeness, legality, availability, or fitness for purpose of any listed property. Users are solely responsible for conducting independent due diligence before entering into any property transaction.

7. Payments & Premium Services

Some features (such as premium listings, featured placements, and promotional packages) are available for a fee. All payments are subject to our Refund Policy. Prices are in Indian Rupees (INR) and inclusive of applicable GST. We reserve the right to change pricing at any time with 14 days' notice.

8. Intellectual Property

All content on the Aadya Acres Platform — including but not limited to the app design, logo, brand name, trademarks, software code, text, graphics, and user interface — is the exclusive intellectual property of Aadya Acres Pvt. Ltd. and is protected under the Copyright Act 1957, Trade Marks Act 1999, and other applicable Indian IP laws. No content may be copied, reproduced, distributed, or commercially exploited without our express written consent.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

10. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without any warranties of any kind, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or harmful components.

11. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Aadya Acres Pvt. Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use the Platform, or from any property transaction facilitated through the Platform. Our total liability to you for any claim shall not exceed the amount you paid us in the 6 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Aadya Acres Pvt. Ltd., its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of your use of the Platform, violation of these Terms, or infringement of any third-party rights.

13. Termination

We may suspend or permanently terminate your account at any time, with or without cause, including for violation of these Terms. You may terminate your account at any time by following the account deletion process in the app. Upon termination, your right to use the Platform ceases immediately.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

15. Changes to These Terms

We may revise these Terms at any time. We will notify you of material changes at least 14 days in advance via the app or email. Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance.

1. Scope of This Policy

This Refund Policy applies exclusively to paid products and services offered by Aadya Acres Pvt. Ltd., including:

• Premium property listings and featured placements
• Boosted listing subscriptions (Silver, Gold, Platinum plans)
• Verified Agent / Builder subscription plans
• One-time promotional services

This policy does not cover third-party services, commissions paid to independent agents, or any agreements made directly between users outside our Platform.

2. Refund Eligibility

You may request a full refund within 7 days of payment if any of the following apply:

• The service or feature you purchased was not activated or delivered as described
• A technical error on our platform resulted in a duplicate charge
• Your listing was rejected by our moderation team despite fully complying with our listing guidelines (the rejection must be on our side, not due to your policy violation)
• You were charged incorrectly due to a billing system error

3. Non-Refundable Situations

Refunds will not be issued in the following circumstances:

• You changed your mind or no longer need the service after it was successfully activated
• Your listing or account was removed, suspended, or rejected due to violation of our Terms of Service or listing guidelines
• The service period has been partially or fully consumed
• The refund request is made more than 7 calendar days after the original transaction date
• The issue arises from incorrect information you provided during the listing process
• Market conditions, buyer/tenant interest, or the property's performance on the platform

4. Subscription Plans

For monthly or annual subscription plans, refunds are available on the following basis:

• Monthly plans: Eligible for a full refund if requested within 48 hours of purchase and the plan has not been used.
• Annual plans: Eligible for a pro-rated refund for the unused months, less any applicable processing fees, if requested within 30 days of purchase and usage has been minimal.

5. How to Request a Refund

To request a refund, please email refunds@aadyaacres.com with the following information:

1. Your registered email address and account name
2. Transaction ID or Order ID (found in your receipt or account → billing history)
3. Date of purchase
4. Amount paid
5. Reason for the refund request (with any supporting screenshots)

Our team will review your request and respond within 3 business days. Approved refunds will be processed to the original payment method (credit card, debit card, UPI, or net banking) within 5–7 business days after approval.

6. Disputes

If you are unsatisfied with our refund decision, you may escalate the matter by emailing grievance@aadyaacres.com addressed to our Grievance Officer. We are committed to resolving all disputes fairly and in accordance with applicable Indian consumer protection laws.

We provide a platform for property owners, real estate agents, and developers to publish property listings, and for buyers and tenants to discover them. We are not party to any transaction, contract, or agreement between users of the Platform.

2. No Warranty on Property Information

All property listings are created and submitted by independent users, agents, or builders. While Aadya Acres takes reasonable steps to verify listings, we make no warranty — express or implied — as to the accuracy, completeness, legal status, availability, or quality of any listed property. Property details including photographs, dimensions, amenities, and pricing are provided by the listing owner and may change without notice.

Users are strongly advised to:

• Physically inspect any property before making any financial commitment
• Independently verify all property documents, title deeds, and encumbrance certificates
• Consult a qualified lawyer before signing any agreement
• Verify the seller's/agent's identity and authority to sell or rent the property
• Never transfer any money to an unknown party without completing legal verification

Nothing on the Aadya Acres Platform constitutes financial advice, investment recommendations, or any form of regulated financial service. Property prices shown are indicative only and may vary based on negotiation, market conditions, legal charges, taxes, and other factors. Past performance of real estate markets is not indicative of future results. Always consult a SEBI-registered financial advisor before making real estate investment decisions.

No content on this Platform constitutes legal advice. Information provided about real estate laws, taxes, RERA regulations, or legal processes is for general informational purposes only. Always consult a qualified lawyer for specific legal guidance regarding any property transaction.

5. RERA Compliance

Builders and developers listing projects on Aadya Acres are required to provide their valid RERA registration numbers. Buyers are advised to independently verify RERA registration at your respective state's RERA portal before booking or investing in any under-construction project.

6. Third-Party Content & Links

The Platform may display content from or links to third-party websites, maps, calculators, or service providers. Aadya Acres is not responsible for the accuracy, reliability, or privacy practices of any third-party content or service. The inclusion of any third-party link does not imply our endorsement.

7. Market Information

Any property market trends, price indices, locality insights, or investment information published on the Platform are for general informational purposes and are based on available data at the time of publication. Actual market conditions may differ. Aadya Acres is not liable for any decisions made based on such information.

8. Limitation of Liability

To the fullest extent permissible under applicable Indian law, Aadya Acres Pvt. Ltd. shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages arising from reliance on any information provided on the Platform, any property transaction facilitated through the Platform, or any inability to access or use the Platform.
